
Beverly Hills City Council Affirms Builder’s Remedy Project Despite Local Opposition
The Beverly Hills City Council recently affirmed the approval of a significant "Builder's Remedy" housing project at 232 S. Tower Drive, near the Wilshire/La Cienega Station. This decision rejects an appeal by a group of neighboring homeowners, the Carthay Beverly Hills Neighbors, who aimed to prevent the development. The project, proposed by Beachside Suites, LLC and Oak Investment Co., LLC, was initially approved by the Beverly Hills Planning Commission in October 2025.
The eight-story building is planned to feature 55 studio and one-bedroom apartments, including 11 designated as affordable units. Designed by Ottinger Architects, the contemporary infill complex benefits from "Builder's Remedy" provisions because Beverly Hills had not secured state certification for its housing element at the time of submission. This status exempts the project from local zoning restrictions on height and density.
Neighbors appealed, citing violations of local zoning, state environmental law, and federal policies. However, a city staff report concluded that state law limits the city's power to reject such projects. The Council, while expressing reluctance, voted to uphold the approval, adding conditions related to construction hours and public notice. This outcome underscores how state-level housing mandates can compel local governments to approve projects that might otherwise face significant local opposition and zoning hurdles.
